Byggnadsinspektör hade inte rätt att vid utmärkande av byggnadsplats

på marken med avvikelse från byggnadslovet anvisa

en byggnadsplats som var belägen på cirka 6 meters avstånd

från grannes lägenhet, då ifrågavarande bastubyggnad enligt

den i byggnadslovshandlingarna ingående situationsplanen

skulle uppföras på cirka 13 meters avstånd från sagda lägenhet.
