Legislator summary

AI generated

The Administrative Court of Vaasa allowed the tax authority's decision to classify income received by a forest management association as non-business income. The association argued the payments were merely cost reimbursements to maintain operational capacity without profit intent, while the tax authority treated the sum as taxable business revenue. The court upheld the authority's view that the nature of the transaction, rather than the stated purpose, determined its tax character.

Yleishyödylliseksi yhteisöksi katsottu X:n Metsänhoitoyhdistys

r.y. oli saanut verovuonna Osuuskunta Y:ltä korvauksena

osuuskunnan tekemiin puutavaran hankinta- ja pystykauppoihin

liittyvistä hankintapalveluista yhteensä 197.756,69 markkaa.

Verotuksessa tuo määrä oli katsottu yhdistyksen veronalaiseksi

liiketuloksi.

Yhdistyksen ja mainitun osuuskunnan välillä tehdyn sopimuksen

mukaan korvaukset oli tarkoitettu täysimääräisesti kattamaan

yhdistykselle hankintapalveluista aiheutuvat kustannukset.

Ilmoituksensa mukaan yhdistys harjoitti puheena olevaa toimintaa

voidakseen pitää henkilökuntansa ja siten palvelukykynsä

kesän metsänviljelytöiden ja syksyn leimaustöiden

työhuippujen vaatimalla tasolla eikä toiminnan tarkoituksena

ollut tuottaa voittoa. Lääninoikeus katsoi, että näissä

oloissa tuosta toiminnasta saatua tuloa ei voitu pitää liiketulona,

josta yhdistys olisi verovelvollinen. Verovuosi 1984.
