Inheritance tax surcharges paid during the decedent's life are deductible from estate value.
Legislator summary
AI generatedThe Administrative Court allowed the appeal against the County Court's decision to permit deductions for stamp duty and surcharges paid by the decedent before death. The plaintiff had paid these taxes in 1985 and argued they should reduce the taxable estate value. Perinnönjättäjä kuoli 12.6.1984. Hän oli 26.3.1984 ostanut
asuntoon oikeuttavat osakkeet. Perillinen esitti leimaverolaskelman
ja suoritti leimaveron 15.11.1985, jolloin lisäksi
määrättiin suoritettavaksi veronlisäystä ajalta 1.5.1984-
30.11.1985.
