Kuolinpesä oli vuokrannut aikaisemmin vainajan käytössä olleen
osakehuoneiston ja vuokraus tuli jatkumaan useita vuosia.
Kuolinpesällä oli vainajan kuolinvuodelta eläketuloa
8 152 markkaa ja tuloa osakehuoneiston vuokrauksesta 1 364
markkaa. Huoneistosta verovuonna maksetut yhtiövastikkeet
ja vuosikorjauskulut ylittivät vuokratulon määrän. Verolautakunta
oli vähentänyt vuokratulosta menoja vain vuokratuloa
vastaavan määrän eli 1 364 markkaa. Lääninoikeus katsoi,
että kuolinvuonna suoritetut vuosikorjauskulut kohdistuivat
osittain taannehtivasti vainajan elinaikaan ja osittain vuokraustoimintaan.
Kuolinpesän henkilökohtaisesta tulosta voitiin
vähentää vuokratuloon kohdistuvat vuosikorjauskulut
myös vuokratulon määrän ylittävältä osalta. Valituksessa
ei ollut kysymys yhtiövastikkkeiden vähentämisestä. Verovuosi 1980.
Äänestys 2-1.
