Student grant deemed not wages due to lack of employment relationship and direct work connection.
Legislator summary
AI generatedThe Administrative Court dismissed the County Administrative Board's decision classifying a monthly student grant as wages. The Board had determined the grant constituted wages under the Advance Collection Act, but the court found no employment relationship existed between the municipality and the students. Since the grant was not tied to actual work performance and the students were not obligated to work for the municipality, the court ruled it was merely a scholarship, not wages.

Oikeuskysymyksenä asiassa oli, oliko kunnan sosiaalioppilaitoksessa
kodinhoitajiksi opiskeleville oppilaille kuukausittain
maksamaa 500 markan opintoapurahaa pidettävä
palkkana.
Apurahan myöntämisen edellytyksenä oli, että opiskelija valmistumisensa
jälkeen tuli toimimaan vähintään kaksi vuotta
apurahan maksaneen kunnan kotipalvelutehtävissä. Mikäli työsuhdetta
ei syntynyt, opiskelija oli velvollinnen palauttatamaan
saamansa opintoapurahan. Lääninverovirasto oli kunnan
ennakkoratkaisuhakemukseen antamassaan päätöksessä katsonut,
että opintoapuraha oli ennakkoperintälain 4 §:ssä tarkoitettua
palkkaa.
