Gift deemed taxable salary not hidden dividend due to non-standard amount and lack of special occasion status.
Legislator summary
AI generatedThe Administrative Court ruled that a boat gifted to a shareholder for his 70th and the company's 35th anniversary was taxable as salary rather than a hidden dividend. While the tax board classified it as a concealed dividend, the court found the gift was based on the employment relationship and not an exceptional milestone. Consequently, the court determined the value must be included in the employee's salary income for the 1984 tax year.

Yhtiön pääosakas ja hallituksen puheenjohtaja oli saanut
yhtiöltä oman 70-vuotispäivänsä ja yhtiön 35-vuotispäivän
johdosta lahjaksi 22 600 markan arvoisen veneen. Verolautakunta
oli katsonut veneen arvon osakkaan yhtiöltä saamaksi
peitellyksi osingonjaoksi.
Lääninoikeus katsoi, että lahja oli sen antamisen tarkoitukseen
ja olosuhteisiin nähden annettu työsuhteen perusteella.
Lahja ei kuitenkaan ollut määrältään tavanomainen ja kohtuullinen
eikä niin ollen TVL:n 22 a §:n 1 momentin 3 kohdassa
tarkoitettu merkkipäivälahja, jota ei katsota veronalaiseksi
palkkatuloksi. Kun osakkaan yhtiöltä saamat etuudet eivät
yhteensä olleet kohtuuttomat, lahjan arvo oli verotettava
palkkatulona eikä peiteltynä osingonjakona. Verovuosi 1984.
