Legislator summary

AI generated

The Administrative Court of Finland dismissed the claim that ski passes provided to a company's staff constituted a tax-exempt benefit. The company argued the passes were a standard perk, while the court found the material value and nature of the benefit did not meet the statutory criteria for exemption. Consequently, the court ruled the passes were taxable income subject to withholding and social security contributions.

Kommandiittiyhtiö aikoi ostaa henkilökunnalleen Rukan hiihtohissien

käyttöön oikeuttavat valokuvalla varustetut henkilökohtaiset

kausikortit, joiden arvo oli 700-800 markkaa kappale.

Yhtiön henkilökuntaan kuuluivat yhtiön vastuunalaisina

yhtiömiehinä toimivat aviopuolisot, heidän koulua käyvä poikansa,

joka työskenteli yhtiössä koulun loma-aikoina ja lauantaisin,

sekä kaksi muuta työntekijää. Viimeksi mainituista

toinen oli ilmoittanut, että hän ei halua puheena olevaa

etua.

Lääninoikeus katsoi, että yhtiön henkilökunnalleen kustantamia

henkilökohtaisia hiihtohissikausikortteja ei voida pitää

edun luonne ja raha-arvo huomioon ottaen tulo- ja varallisuusverolain

22 a §:n 1 momentin 4 kohdassa tarkoitettuna

Palkanmaksuvuosi 1988.
