Court allows disability service tenant to claim home modification costs not covered by facility standards.
Legislator summary
AI generatedThe Administrative Court of Mikkeli allowed a portion of a tenant's claim for home modification costs under the Disability Services Act. The tenant, residing in a care home where the municipality provided services, sought reimbursement for a new lock and door handle installation, which the Social Board denied as belonging to the facility's standard equipment. The court ruled that because the tenant paid rent for a private rental unit rather than living in the care home itself, the Board could not dismiss the claim solely on the basis of facility standards.

Oikeuskysymyksenä oli, onko palvelutalossa asuvalle vammaiselle
korvattava asunnon muutostöistä aiheutuvia kustannuksia
vammaispalvelulain nojalla.
Henkilö A asui palvelutalossa, josta A:n kotikunta osti
A:lle järjestettäviä asumispalveluja. A maksoi itse asunnon
vuokran.
Sosiaalilautakunta hylkäsi A:n hakemuksen, joka koski korvauksen
saamista sähkölukon ja yksiotesekoittajien asentamisesta
aiheutuvista kustannuksista, sillä perusteella, että
tällaisten varusteiden tulisi kuulua palvelutalon varustetasoon.
Lääninoikeus palautti asian uudelleen käsiteltäväksi, koska
kysymyksessä oli A:n vuokra-asunto eikä lautakunta olisi
saanut mainitsemallaan perusteella hylätä hakemusta.
