Tax court allows home-to-work travel deductions only for days with breaks exceeding three and a half hours.
Legislator summary
AI generatedThe Administrative Court partially allowed deductions for a property manager's home-to-work travel costs, permitting them only for days with breaks exceeding three and a half hours. While the Tax Board approved all round-trip costs, the Court reduced the deductible amount by returning three-fifths of the claimed expenses for shorter breaks. The decision established that travel between work shifts is deductible solely when the intervening rest period meets the statutory duration threshold.

matkoista.
Päivittäinen työaika oli 6.30-11.00 ja 13.00-16.30 kolmena
päivänä viikossa ja 6.30-11.00 ja 14.30-18.00 kahtena päivänä
viikossa. Edestakainen matka oli 10 km ja oma auto
oli hyväksytty halvimmaksi kulkuneuvoksi.
Verolautakunta hyväksyi päivittäiset matkakustannukset molempien
edestakaisten matkojen osalta eli 20 km/pv.
Asiamies vaati toisen päivittäisen edestakaisen matkan kustannukset
palautettavaksi tuloon.
Lääninoikeus katsoi myönnetyt matkakustannukset vähennyskelpoisiksi
niiden päivien osalta, jolloin työjaksojen välinen
tauko oli kestänyt kolme ja puoli tuntia. Lääninoikeus palautti
tuloon vähennyskelvottomina elantomenoina 3/5 vaaditusta
määrästä.
