Sosiaalilautakunta oli myöntänyt toimeentulotukea ajalle

12.9. - 4.12.1984 ennakkona odotettavissa olevaa tapaturmaviraston

maksamaa rikosvahinkokorvausta vastaan. Tapaturmavirasto

maksoi korvausta kuluista, ansionmenetyksestä sekä pysyvästä

kosmeettisesta haitasta. Valittaja esitti, että lautakunta

voi periä hänelle pahoinpitelyn vuoksi maksetuista

korvauksista sen osuuden, jota vastaaviin menoihin toimeentulotukea

oli myönnetty. Lääninoikeus katsoi, että kyseinen

korvaus oli sellainen sosiaalihuoltolain 38 §:n tarkoittama

kertakaikkinen korvaus, jonka lautakunta voi käyttää toimeentulotukikustannusten

korvaamiseen siltä ajalta kuin tukea on

annettu ennakkona. Lautakunta velvoitettiin palauttamaan valittajalle

tapaturmaviraston maksamasta korvauksesta se osa,

joka oli suoritettu valittajan itsensä 26.4.1985 maksamista

kuluista, koska valittaja ei ollut tuolloin saanut toimeen-

tulotukea.
