Finnish Administrative Court allows property income deduction for rent paid directly to housing association.
Legislator summary
AI generatedThe Administrative Court of Finland allowed a property income deduction for rent payments made directly to a housing association. The tax authority had initially approved the deduction, but the taxpayers appealed to have it removed. The court ruled that natural deductions must be considered when calculating the deduction amount, even if no taxable rent remains after the housing fee is subtracted. Consequently, the court dismissed the appeal and upheld the original decision to grant the deduction.

Voitiinko vuokratuloista myöntää omaisuustulovähennys, kun
huoneistojen vuokralaiset olivat suorittaneet vuokrana yhtiövastikkeen
määrän, mikä oli maksettu suoraan asuntoyhtiölle.
Verolautakunta oli hyväksynyt omaisuustulovähennyksen vuokran
suuruisena, mistä ratkaisusta veronsaajat valittivat lääninoikeuteen
vaatien myönnetyn vähennyksen poistamista.
Lääninoikeus katsoi, että vuokralaiset olivat suorittaneet
vuokranantajalle vuokrana yhtiövastikkeiden määrän, minkä he
olivat maksaneet suoraan yhtiölle. Omaisuustulovähennyksen
määrää laskettaessa ei po. verovuonna otettu huomioon vuokratulosta
tehtäviä luonnollisia vähennyksiä. Omaisuustulovähennys
on myönnettävä vuokratulon osalta, vaikkei siitä yhtiövastikkeen
vähentämisen jälkeen ole jäänyt verotettavaa
vuokratuloa. Näin ollen lääninoikeus hylkäsi asiamiehen vali-
tuksen.
