Voitiinko lääninhallituksen rakennuslain 132 §:n nojalla myöntämästä poikkeusluvasta poiketa.

S oli hakenut lupaa siirtää saunarakennus hänelle myönnetyn poikkeusluvan mukaiselta rakennuspaikalta naapurin rakennuspaikasta vuokraamalleen alueelle. Lääninoikeus totesi, ettei rakennuslautakunnalla ollut rakennuslain 132 §:n 2 momentin nojalla oikeutta poiketa lääninhallituksen myöntämästä poikkeusluvasta.
