Tax court allows employer to deduct car expenses from rental income for free car allowance cases.
Legislator summary
AI generatedThe Administrative Court allowed the tax authority to treat rental income from a free car allowance as taxable while permitting specific deductions. The taxpayer argued that expenses for private trips should be deducted from the rental income, whereas the authority sought to calculate the allowance based on fuel costs for private use. The court upheld the authority's method, confirming that rental income can be offset by the employer's private trip fuel costs and the taxpayer's operational expenses.

Verovelvollinen oli vuokrannut omistamansa henkilöauton työnantajalleen.
Työnantaja oli antanut auton verovelvollisen
käyttöön sopimuksin, että kyseessä oli vapaa autoetu. Autoa
oli käytetty myös työnantajan määräämiin työajoihin. Verolautakunnalla
oli ollut oikeus VerotusL 56 §:n nojalla autoedun
verottamisen sijasta menetellä siten, että verovelvollisen
tuloksi luettiin vuokratulo ja työnantajan suorittamien yksityisajoihin
kohdistuvien polttoainekulujen määrä ja tulosta
vähennettiin verovelvollisen suorittamat työajoihin kohdistuvat
korjaus-, vakuutus- ja muut autokulut. Asiassa oli kysymys
myös työ- ja yksityisajojen sekä polttoainekulujen määrästä.
Verovuosi 1981.
