Administrative court dismissed tax deduction claim for student commuting trips as they did not contribute to income generation.
Legislator summary
AI generatedThe Administrative Court of Finland dismissed the taxpayer's claim for travel expense deductions made during the 1983 tax year. The taxpayer, a student residing in city T, argued that weekend trips to their home town were necessary for income generation, but the lower authority ruled that the primary reason for moving was education, not temporary employment. The court upheld this decision, establishing that student commuting does not qualify as income-generating activity under the relevant tax provisions.

Verovelvollinen oli opiskellut verovuonna T:n kaupungissa
teknillisessä oppilaitoksessa ja työskennellyt kesäajan
opiskelupaikkakunnalla. Lääninoikeus katsoi, että syynä
verovelvollisen muuttamiseen kotipaikkakunnaltaan T:n kaupunkiin
oli ollut opiskelu eikä tilapäinen työskentely.
Tähän nähden verovelvollisen työskentelyaikana viikonloppuisin
kotipaikkakunnalleen tekemien matkojen ei katsottu
liittyneen sillä tavoin verovelvollisen tulonhankintaan,
että matkakustannukset olisivat olleet vähennyskelpoisia
hänen tulostaan. Verovuosi 1983.
