Oikeuskysymyksenä asiassa oli, onko Tampereen yliopistossa

kunnallistutkinnon suorittanut henkilö pätevä apulaiskaupunginsihteerin

virkaan, johon vaaditaan virkaan soveltuva

yliopiston tai korkeakoulun loppututkinto.

Lääninoikeus totesi päätöksessään, että kaupungin apulaiskaupunginsihteerin

virkaan valittu X oli suorittanut Tampereen

yliopistossa kunnallistutkinnon ja saanut sosionomin

arvon. Hän on siten suorittanut korkeakoulututkintojen määrittelystä

sekä eräiden opintosuoritusten vastaavuudesta

12.3.1982 annetun asetuksen 3 §:ssä tarkoitetun alemman

korkeakoulututkinnon. Sanotun asetuksen 7 §:n mukaan, jos

kelpoisuusehtona valtion virkaan tai toimeen on korkeakoulussa

suoritettu tutkinto tai loppututkinto, kelpoisuus on

henkilöllä, joka on suorittanut alemman tai ylemmän korkeakoulututkinnon.

Lääninoikeus katsoi, että samaa periaatetta

voidaan soveltaa tässä tapauksessa ja että X siis täyttää

suorittamansa tutkinnon osalta puheena olevan viran pätevyysvaatimukset.
