Kunnan terveyskeskuksen talouspäällikön virka julistettiin 11.9.1985 haettavaksi. Kunnanvaltuusto hyväksyi 7.10.1985 terveyskeskukselle johtosäännön, jossa määriteltiin talouspäällikön pätevyysvaatimukset. Johtosääntö tuli voimaan 1.1.1986. Valtuusto valitsi 18.11.1985 talouspäälliköksi 1.1.1986 lukien J:n, joka ei täyttänyt johtosäännössä asetettuja pätevyysvaatimuksia. LO katsoi, että talouspäällikön pätevyysvaatimuksina oli vaalia toimitettaessa ollut pidettävä johtosäännössä asetettuja vaatimuksia. Näin ollen ei J:tä oltu voitu valita virkaan.
