Estate tax appeal dismissed; joint estate partners cannot be taxed separately on author's royalties.
Legislator summary
AI generatedThe Administrative Court dismissed the appeal against the tax authority's decision to levy estate tax on author's royalties. The estate partners argued they should be taxed jointly, but the court found the estate was already treated as a joint entity for royalty distribution purposes. Consequently, the court ruled that taxing the estate separately as a distinct taxpayer was legally inconsistent with its prior status as a shared asset.

Perinnönjakokirjassa oli sovittu kuolinpesälle vainajan kirjallisen
tuotannon perusteella vastedes kertyvistä tekijänpalkkioista
siten, että oikeus niihin pidettiin pesänosakkaiden
yhteisenä. Vuosittain maksettavat tekijänpalkkiot jaetaan
välittömästi osakkaille näiden murto-osuuksien mukaan
sen jälkeen kun tekijänpalkkiot saadaan nostaa. Tämän johdosta
kuolinpesä katsottiin jaetun myös tekijänpalkkioiden osalta,
eikä sitä voitu verottaa erillisenä verovelvollisena.
