The Constitutional Court rejected the inclusion of third-party submissions in proceedings concerning a positive competence conflict between the State and the Basque Government. The State argued that collective representation rights for public employees fall under its exclusive legislative competence under Article 149.1.1 and 18 of the Constitution, while the Basque Government intervened in the union elections. The Court decided to exclude these submissions because the third parties lacked direct standing to intervene in a conflict of competence initiated by the State.
