El Consejo Ejecutivo de la Generalidad de Cataluña plantea conflicto positivo de competencia en relación con el Real Decreto 666/1986, de 21 de febrero, por el que se da nueva redacción a los arts. 39, 145, 146 y 149 del Reglamento de Ordenación de

Transportes Mecánicos por Carretera, por entender que dichos preceptos vulneran las competencias exclusivas que en materia de transporte ostenta la Generalidad de Cataluña en virtud de lo establecido en el art. 9.15 de su Estatuto de Autonomía.
