Municipal supervisory order proportionality and constitutional funding obligations under the guarantee of municipal self-administration
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court granted the plaintiff's complaint and admitted the appeal to the higher court, finding that the case holds fundamental significance for the clarification of constitutional principles. The dispute concerned the proportionality of a municipal supervisory order and whether the defendant authority's failure to secure necessary funding for municipal associations in violation of its constitutional obligations under the Hessian Constitution could excuse the plaintiff's financial distress. The court held that it remains to be determined in the appeal proceedings whether disregarding the proportionality of the supervisory measure is compatible with the guarantee of municipal self-administration under Article 28 Paragraph 2 Sentence 2 of the Basic Law, while provisionally setting the value in dispute for the appeal.

Revisionszulassung; kommunalaufsichtliche Verfügung; Garantie der kommunalen Selbstverwaltung
[GRUENDE]
