Legislator-Zusammenfassung

The Federal Administrative Court granted the plaintiff's complaint and admitted the appeal to the Bundesverwaltungsgericht on the grounds of fundamental legal significance, reversing the lower court's implicit refusal. The case concerned a civil servant employed by the Joint Task Force (ARGE), who challenged the compulsory assignment to a joint entity ("gemeinsame Einrichtung") that continued the joint tasks of the ARGE, as well as the interpretation of the "important reason" required for terminating such an assignment. The decisive legal basis comprises Section 44g Paragraph 1 Sentence 1 and Paragraph 5 Number 2 of the Second Book of the Social Code (SGB II), addressing whether such an assignment can be enforced against the employee's will and how "important reasons" for termination are to be construed.
