The Federal Administrative Court (BVerwG) granted the plaintiff's complaint and permitted the revision appeal, ordering that the case be referred to the BVerwG for a decision on its merits. The dispute concerned the constitutional validity of transferring a civil servant to a higher-ranking position on a temporary basis for seven years under the Lower Saxony School Act, and the legal consequences of potential invalidity for affected civil servants. The decisive legal issue identified for clarification is whether such time-limited appointments for seven years are compatible with Article 33(5) of the German Basic Law, specifically addressing the right to transfer to the held office and the claim for renewed consideration in the event of nullity.

Beschluss vom 27. September 2007 - BVerwG 2 C 21.06 u.a.
