Public notice requirements for environmental topic characterization in formal building plan participation
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) granted the applicant's complaint, admitted the appeal on revision due to a subsequent divergence of case law, and consequently ordered the lower court's judgment to be reopened. The dispute concerned whether municipalities must explicitly summarize specific environmental topics in public notices for formal public participation during the building planning process, rather than merely providing a general reference to the environmental report. Applying § 132(2) No. 2 of the Administrative Court Procedure Act (VwGO), the court found a divergence from its prior precedent, which mandates that environmental issues identified in existing submissions must be grouped by topic blocks and characterized keyword-style in the public notice, a requirement that the lower administrative court had failed to meet by deeming a general reference sufficient under certain circumstances.
