Inclusion of non-qualifying residential plots in agricultural land reordering proceedings under §§ 53, 64 LwAnpG
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) allowed an appeal (Revision) and dismissed the plaintiff's challenge, thereby prevailing for the defendant on procedural grounds. The dispute concerned the inclusion of residential plots (Hausgrundstücke) that did not independently meet the statutory requirements for land reorganization in an agricultural land ordering procedure (Bodenordnungsverfahren). The decisive legal issue was a conflict between the lower court's ruling—which held that such plots could not be included without a specific interest in reorganization under § 53 Abs. 1 LwAnpG—and the established legal principle that plots failing to satisfy the conditions of § 64 LwAnpG may still be included if their exclusion would prevent a sensible resolution of the underlying property conflict, particularly regarding infrastructure development. The court ordered that the case proceed to revision to resolve this divergence in case law.

Revisionszulassung; Einbeziehung von Grundstücken in Bodenordnungsverfahren
[GRUENDE]
