The Federal Administrative Court granted leave to appeal, allowing the case to proceed to the Supreme Court after finding the plaintiff's complaint against the lower court's rejection of leave to be well-founded; the court did not issue a final judgment on the merits but determined that the revision should be heard to resolve a significant open legal question. The dispute concerned the validity of a municipal preservation ordinance (Erhaltungssatzung) aimed at maintaining a specific pattern of perimeter block development (Blockrandbebauung), specifically whether such a building arrangement could be protected solely for its sound-absorbing function for neighboring structures. The decisive legal issue centers on § 172(1) sentence 1 no. 1 of the German Building Code (BauGB), requiring clarification on whether this provision provides a sufficient legal basis for a preservation ordinance when the exclusive purpose is acoustic protection rather than broader structural or aesthetic preservation.

Revisionszulassung; Blockrandbebauung durch Erhaltungssatzung

[GRUENDE]
