Impact of alcohol consumption on reliability and personal suitability for firearm possession
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court vacated the Higher Administrative Court’s refusal to admit an appeal and ordered the admission of the revision, with the final outcome on the merits to be determined by the same Senate in the main proceedings. The dispute concerned weapons law, specifically whether alcohol consumption affects an individual's reliability and personal suitability for firearm possession, a challenge that resulted in the intermediate court initially denying appellate review. The decisive legal basis for this procedural order is § 132(2) No. 1 VwGO, under which the court found the case to be of fundamental legal significance (*grundsätzliche Bedeutung*) as it requires clarification of the impact of alcohol intake on suitability criteria in the Weapons Act.
