Scope of continued employment protection for substitute members of youth representation under § 9 BPersVG
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) ordered the admission of a legal appeal (Rechtsbeschwerde) filed by parties 1 through 3, converting the proceeding from a complaint (Beschwerde) into a legal appeal and continuing it under a new file number, while starting a two-month deadline for the appeal's substantive grounds. The dispute concerns whether substitute members of the youth representation who step in due to the unavailability of original members are entitled to continued employment protection under the Federal Personnel Representation Act (BPersVG). The court permitted the appeal to resolve conflicting jurisprudence between prior BVerwG decisions and a Federal Labor Court (BAG) ruling on the specific scope of continued employment protection for such substitute members in cases of prevention (Verhinderungsfall).
