The Federal Administrative Court (BVerwG) ordered the continuation of the proceedings as a legal appeal (Rechtsbeschwerde) under the docket number BVerwG 6 P 7.13 and initiated a two-month period for the appellant to file a written justification. This procedural decision resolved a dispute regarding whether successor alternate members of a youth body in public service are entitled to protection against termination (Weiterbeschäftigungsschutz) in cases of prevention, a matter that had produced conflicting rulings between the BVerwG and the Federal Labor Court (BAG). The court authorized the review based on the need to establish legal unity for this specific issue, relying on §§ 83(2) BPersVG, 72(2) No. 1, and 92(1) Sentence 2 ArbGG in conjunction with § 9 BPersVG, while noting that the underlying substantive question of protection scope remains to be decided in the ongoing legal appeal.
