Admission of statutory appeal to review works council's statutory right to information on monitoring of working-time regulations
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court's 6th Senate admitted the statutory appeal filed by the works council applicant, thereby allowing the case to proceed to the appellate level for substantive review. The dispute concerns the scope of the works council's right to information under German labor law, specifically regarding the employer's compliance with and monitoring of working-time regulations. The court based its decision on § 83(2) of the Public Employees Data Protection Act (BPersVG) in conjunction with §§ 72(2)(1), 92(1) sentence 2 of the Labor Court Act (ArbGG), finding that the matter presents an opportunity to clarify the legal standards governing the works council's information claims in the context of time-recording and oversight duties.
