Impairment of monument protection interests by a rural-area project under § 35 Abs. 3 Satz 1 Nr. 5 Alt. 4 BauGB
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) granted leave to appeal, finding the appellant's complaint well-founded and allowing the case to proceed to the appellate level. The dispute concerned a land-use planning matter involving a non-standard project in the rural area, specifically challenging whether such a project infringes upon public interests related to monument protection. The court determined that the revision proceedings are necessary to clarify the legal prerequisites under § 35 Abs. 2 and § 35 Abs. 3 Satz 1 Nr. 5 Alt. 4 BauGB, which govern the assessment of public interests and potential impairments of heritage protection for projects outside of zoned urban areas.
