Exclusion of appeal against legal aid denial in open property issues compensation proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court dismissed the appellant's complaint as inadmissible and rejected her application for legal aid, effectively upholding the lower court's denial of assistance and rendering its decision final. The dispute arose in a property law proceeding under the Act on the Settlement of Open Property Issues, where the appellant sought to challenge the Administrative Court of Greifswald's refusal to grant legal aid and appoint a lawyer for appeal proceedings. The court held that the appeal was barred because § 12 Abs. 1 Satz 1 of the Compensation Act in conjunction with § 37 Abs. 2 Satz 1 of the Act on the Settlement of Open Property Issues explicitly excludes legal remedies against any decision of the administrative court in such matters, including orders denying legal aid. Consequently, the appeal lacked a prospect of success, leading to the rejection of the request for legal aid under § 166 VwGO in conjunction with § 114 Satz 1 and § 121 Abs. 1 ZPO.
