Exemption from school attendance for religious reasons under parental education rights and freedom of religion
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court allowed the appeal against the refusal of leave to appeal, granting the defendant the right to bring a revision to the court, thereby finding that the case is of fundamental significance. The dispute concerned a claim by parents for their child to be exempted from compulsory participation in a specific school event, based on the constitutional right of parental education in religious matters. The court held that the issue requires further clarification regarding the specific conditions under which the joint fundamental rights of parental education and religious freedom justify an individual exemption from school attendance duties.
