Admissibility of revision in private school approval case: fundamental significance of interpreting "educational goals" under Art. 7(4) Sentence 3 GG.
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court granted the defendant's complaint against the lower court's refusal to permit appeal, ruling that the legal question possesses fundamental significance and thereby allowing the case to proceed to the Revisionsverfahren. The dispute concerned the authorization of private schools as substitutes for public schools, specifically challenging the interpretation of the mandatory "educational goals" requirement for such institutions under German constitutional law. The decisive legal basis for the admissibility of the appeal was Section 132(2) No. 1 of the Administrative Court Rules (VwGO) regarding fundamental legal questions, which enabled the court to further clarify the prerequisites for private school authorization established in Article 7(4) Sentence 3 of the Basic Law.
