Permissibility of unwinding a fully performed public-law contract under § 60 VwVfG due to essential change of circumstances
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court granted the defendant's appeal for leave to appeal, ruling that the case possesses fundamental legal significance and permitting the matter to proceed to full revision proceedings, while also setting the provisional disputed amount for the appeal. The dispute concerns the validity of the unwind of a fully performed public-law contract in light of a subsequent essential change in circumstances, challenging whether such an adjustment is permissible. The decisive legal issue centers on the applicability and prerequisites of Section 60 (1) of the Administrative Procedure Act (VwVfG) regarding contract adaptation versus retroactive unwinding, evaluated under Section 132 (2) No. 1 of the Administrative Court Rules (VwGO) for admission to revision.
