Constitutional limits on municipal district levies: compatibility of credit-demanding revenue absorption with Article 28(2) GG
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court granted leave to appeal to the plaintiff, finding that the appeal raises a question of fundamental legal significance regarding the compatibility of district levies (Kreisumlage) with Article 28(2) of the German Basic Law when such levies, combined with other mandatory contributions, exceed municipal revenues and necessitate credit borrowing to finance voluntary administrative tasks. The case centers on a challenge to the collection of a district levy, where the plaintiff argued that the financial burden violates constitutional principles of municipal self-administration, particularly given that the municipal sector has been chronically underfunded and the levy system aims to distribute deficits more evenly among municipalities. The decisive legal issue is whether the structural underfinancing of municipalities justifies a levy structure that absorbs more than their available revenues, a question the court deemed suitable for clarification in a subsequent revision proceeding.

Zur krediterfordernden Einnahmenabschöpfung durch Kreisumlage
[GRUENDE]
