The Federal Administrative Court granted the plaintiff's complaint for leave to appeal and admitted the revision, ruling that the plaintiff's procedural arguments regarding a violation of the right to be heard were inadmissible for failure to meet statutory disclosure requirements. The case concerns a Turkish national challenging the loss of his association-law residence right based on having left the host member state for a significant period without valid reasons. The court found that the revision serves the fundamental importance of clarifying the specific prerequisites under which a departure from the host state constitutes a loss of residence rights, thereby prevailing in the admissibility phase of the litigation. The decisive legal basis is Article 7 of Decision 1/80 of the Association Council, interpreted in conjunction with § 132(2) No. 1 and No. 3, § 108(2), and § 133(3) Sentence 3 of the Federal Administrative Court Rules of Procedure (VwGO), alongside Article 103(1) of the Basic Law regarding the right to be heard.

Assoziationsrechtliches Aufenthaltsrecht; Rechtsverlust durch Verlassen des Aufnahmemitgliedstaats; Revisionszulassung

[GRUENDE]
