Legislator-Zusammenfassung

The Federal Administrative Court allowed the applicant’s complaint, finding that the case had fundamental legal significance under § 132 Abs. 2 Nr. 1 VwGO, and ordered the matter to proceed to revision; the applicant prevailed in the admissibility stage. The dispute concerned the scope of a university professor’s teaching obligations, specifically challenging whether the credit value of voluntary teaching events offered by the professor is counted toward the mandatory teaching load and whether an over-provision of teaching must result in a corresponding reduction of the statutory teaching duty. The decisive legal basis centers on the freedom of science, research, and teaching guaranteed by Art. 5 Abs. 3 Satz 1 of the German Basic Law, which frames the conditions under which voluntary teaching contributions interact with mandatory professional obligations.

Umfang der Lehrverpflichtung eines Hochschullehrers

[GRUENDE]
