Revocation of right to use foreign EU driving license based on subsequent negative German driving aptitude report
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) granted the leave to appeal, finding that the case possesses fundamental legal significance, and set a provisional value in dispute for the subsequent revision proceedings. The dispute concerns whether a negative driving aptitude report submitted to German authorities after the issuance of an foreign EU driving license empowers the German licensing authority to revoke the right to use that license within Germany. The decision allows the court to clarify the specific preconditions under which such a revocation is permissible, following its earlier 2010 judgment, with the procedural basis relying on § 132 Abs. 2 Nr. 1 VwGO for fundamental significance and §§ 47, 52, and 63 GKG for the value in dispute.

Fahreignungsgutachten; ausländische EU-Fahrerlaubnis
[GRUENDE]
