Refusal of recognition of foreign EU driver's license following prior domestic revocation under Directive 2006/126/EC
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) granted the complaint for non-admission of the appeal (Beschwerde), holding that the case possesses fundamental significance for a future revision hearing. The dispute concerns the German authorities' power to refuse recognition of a driving license issued by another EU or EEA member state, specifically when the applicant had previously had a German license revoked or was subject to other measures under the relevant German regulations. The core legal issue to be resolved in the subsequent revision is whether § 28(4) sentence 1 no. 3 of the Driver's Licence Ordinance (FeV), in conjunction with Article 2(1) and Article 11(2) and (4) of EU Directive 2006/126/EC, permits the host Member State to deny recognition of the foreign license on these grounds. The court set the preliminary value in dispute for the proceedings based on the applicable court costs rules.

[GRUENDE]
