Binding effect of a prior revision ruling on the factual entitlement in a second-instance asset rights case
Legislator-Zusammenfassung
KI-generiertThe BVerwG allowed the plaintiff's appeal for admission to the Federal Administrative Court, granting the plaintiff's request to overturn the lower court's dismissal. The dispute concerns property rights law (Vermögensrecht), specifically whether the administrative court was bound by a prior revision ruling that had affirmed the plaintiff's entitlement to restitution but refrained from a final decision on the merits due to missing factual findings on exclusion grounds; the central legal issue is the binding effect of that prior judgment on the res judicata status of the plaintiff's entitlement in the second instance proceedings. The court relied on § 132 Abs. 2 Nr. 1 VwGO (fundamental significance) to admit the revision, noting that the court may apply this ground ex officio even when the appellant argues procedural error under § 144 Abs. 6 VwGO, as the underlying question of the extent of factual and legal binding between instances is of fundamental importance.

Februar 1973 - BVerwG 8 B 4.73 - Buchholz 310 § 132 VwGO Nr. 103).
