Legislator-Zusammenfassung

The Federal Administrative Court dismissed the objection filed by one of the co-debtors, confirming that the cost assessment is valid and upholding the prior ruling that the plaintiffs bear the costs of the complaint proceedings. In a dispute concerning the internal liability relationships among joint cost debtors in litigation, a plaintiff challenged their demand for payment based on a cost assessment that collected fees from all liable parties in equal shares. The court held that under § 32(1) GKG and § 421 BGB, the plaintiff is a joint debtor for the entire court costs, and where the state treasury is the creditor, its discretion in selecting debtors is governed by administrative directives. Specifically, citing § 8(3) of the Cost Directive for the Courts (KostVfG), the court ruled that the state treasury need not investigate or consider the internal liability ratios among debtors but is entitled to claim costs from all joint debtors in equal parts.

Zum Innenverhältnis der Kostenschuldner

[GRUENDE]
