State vs. federal competence for public space video surveillance and constitutional requirements for landesrechtliche police authorizations
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court admitted the appeal on the merits and granted the plaintiff legal aid, ordering the appointment of counsel for the proceedings. The dispute concerned the legality of open video surveillance in public spaces for the purpose of crime prevention and law enforcement, challenging whether such measures could be based on state police law or if federal criminal procedure law is exhaustive in this regard. The court found that the appeal meets the requirement of fundamental importance under § 132(2) No. 1 VwGO, as the case raises unresolved questions regarding the scope of federal versus state legislative competence for public surveillance and the constitutional requirements for state-level authorizations.
