The Federal Administrative Court ordered the admission of the appeal (Revision) to the court, granting the defendant's complaint and recognizing the matter as having fundamental significance. The dispute concerned the legal characterization of a subsidy granted by a public state funding bank; specifically, it challenged whether the decision constitutes an administrative act (Verwaltungsakt) when the approval is not communicated directly to the beneficiary but is instead conveyed by sending contract documents to the beneficiary's house bank, which acted as an intermediary. The decisive legal basis is § 132 Abs. 2 Nr. 1 VwGO, which permits admission to the court when a question of fundamental legal significance arises, necessitating clarification on whether such indirect communication via a banking intermediary satisfies the formal requirements for the existence of an administrative act.

Subventionsgewährung durch Landesförderbank; Verwaltungsakt; Verlautbarung gegenüber Hausbank des Zuwendungsempfängers; Revisionszulassung

[GRUENDE]
