The defendant's complaint was successful, resulting in the Federal Administrative Court's admission of the plaintiff's appeal for revision due to the fundamental importance of the legal issue. The dispute concerns a challenge to an administrative act in a matter of local self-management, where the initial decision was issued solely by a private law entity rather than the originating authority, and the case proceeds to determine whether the form assumed by the original decision after a subsequent objection affects liability or procedural standing. The decisive legal basis is Section 132(2) No. 1 of the Administrative Court Code (VwGO), which permits admission of revision when a question of law has fundamental significance, specifically addressing the interaction between municipal self-governance entities and the procedural status of administrative acts.

Revisionszulassung; kommunale Selbstverwaltungsangelegenheit

[GRUENDE]
