Residence rights of former naturalized persons under § 38 AufenthG following retroactive revocation of naturalization
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court granted the plaintiff's complaint and authorized the appeal to the Federal Administrative Court, allowing the case to proceed on the basis of its fundamental significance. The dispute concerned the legal status and residence rights of a foreign national whose naturalization had been revoked with retroactive effect, specifically whether the individual was considered a "former German" under § 38 of the Residence Act and whether the pre-naturalization residence permit continued to be valid or "revived" upon revocation. The decisive legal issue identified for review is the interpretation of § 38 AufenthG and the implications of the retroactive revocation of naturalization on the validity of prior residence titles.

[GRUENDE]
