Legislator-Zusammenfassung

The Federal Administrative Court (BVerwG) allowed the admission of the appeal on points of law, granting the plaintiffs' complaint against the lower court's refusal to admit revision and setting the amount in dispute for both the complaint and revision proceedings. The dispute centers on the compatibility of the German Environmental Legal Remedies Act (UmwRBehG) with EU Community law, specifically challenging whether § 5 UmwRBehG can exclude the application of § 4 UmwRBehG for administrative proceedings initiated before June 25, 2005, even when the final administrative decision was issued after that date. The decisive legal basis involves the requirement for fundamental legal significance under § 132(2)(1) VwGO to resolve the question of whether the temporal transition rules of § 5 UmwRBehG are compatible with higher-ranking Community law obligations.

Umwelt-Rechtsbehelfsgesetz; Vereinbarkeit mit Gemeinschaftsrecht

[GRUENDE]
