The Federal Administrative Court (7th Senate) overturned the Higher Administrative Court of North Rhine-Westphalia’s decision refusing to allow appeal and granted leave for the revision of the lower court’s judgment of March 25, 2025, with the final cost decision reserved for the main proceedings. The dispute concerns administrative planning law and environmental protection, specifically the legal classification of multiple wind energy installations owned by the same operator, situated on a shared operating site, and connected by common facilities, for the purposes of noise assessment under the Technical Instruction on Noise (TA Lärm). The court held that the case involves a matter of fundamental legal significance under Section 132(2) No. 1 of the Administrative Court Rules (VwGO), necessitating a determination on whether such interconnected wind turbines must be treated as a single facility to be assessed jointly for noise impact.

Revisionszulassung; Lärmbetrachtung durch gemeinsame Betriebsanlagen verbundene Windenergieanlagen

[TENOR]

V. m. § 52 Abs. 1, § 63 Abs. 1 GKG.
