The Federal Administrative Court (BVerwG) granted the leave-to-appeal complaint filed by the intervenor, revoking the lower court's refusal to admit the revision and referring the case for substantive review, while leaving cost and final dispute value determinations to the final decision. The dispute concerns a third-party challenge to building permits and whether such administrative acts fall within the scope of the Environmental Rights Directive (UmwRG) and the specific enforcement provisions thereunder. The court admitted the appeal on the grounds of fundamental legal significance under § 132 Abs. 2 Nr. 1 VwGO, as the revision is expected to clarify the extent to which building permits are subject to § 1 Abs. 1 Satz 1 Nr. 5 UmwRG and, consequently, whether third-party annulment actions are governed by § 6 UmwRG.
