The Federal Administrative Court (BVerwG) dismissed an appeal for lack of hearing rights (Anhörungsrüge) and ordered the plaintiff to bear the costs of the proceedings. The dispute concerned a prior decision by the BVerwG that had rejected an appeal against the administrative court's dismissal of a complaint challenging the rejection of a judge’s recusal motion; the plaintiff argued that the BVerwG’s decision violated her right to be heard. The court ruled that the appeal was inadmissible primarily because it was filed by the unrepresented plaintiff herself rather than by a qualified legal representative (attorney or university law professor), as required by law, and additionally because the plaintiff failed to demonstrate any actual violation of her right to be heard in the reasoning of the challenged decision. The decisive legal basis includes § 152a of the Administrative Court Procedure Act (VwGO) regarding the requirements for an Anhörungsrüge, §§ 67 and 68 VwGO regarding mandatory legal representation, and § 154 VwGO for the allocation of costs.

Unzulässige Anhörungsrüge ohne postulationsfähigen Prozessvertreter

[TENOR]

V. m. § 114 Abs. 1 Satz 1, § 121 Abs. 1 ZPO).

Die Anhörungsrüge ist unzulässig. Sie ist nicht gemäß § 152a Abs. 2 Satz 5 i. V. m. § 67 Abs. 4 Satz 1 und 3 i. V. m.
