Legislator-Zusammenfassung

KI-generiert

The Federal Administrative Court overturned the Higher Administrative Court’s decision denying leave to appeal and ordered the admission of the applicant’s legal complaint, thereby prevailing for the applicant in the procedural stage. The dispute concerned whether attorney fees incurred outside the context of a judicial order proceeding constituted necessary expenses for the activity of the works council under German public service law, which had been contested by the authority. The decision rests on the finding of a decisive legal question of fundamental significance regarding the classification of such costs under § 42 Abs. 1 PersVG LSA in conjunction with §§ 78 Abs. 2 PersVG LSA, 72 Abs. 2 Nr. 1, and 92 Abs. 1 Satz 2 ArbGG, establishing that the matter requires review by the Senate to clarify the statutory interpretation.
